General Terms and Conditions
for trainings and services of the company Mindshift to Excellence GmbH
§1 Applicability to entrepreneurs and definition of terms
The following General Terms and Conditions apply between us and a client or consumer in the version valid at the time of the order for all orders for consulting, training and similar services, unless otherwise agreed in writing.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity (§ 13 BGB).
§2 Conclusion of a contract, storage of the contract text
(1) The following regulations concerning the conclusion of a contract apply to orders placed via our website (homepage) https://www.mindshift.world.

(3) The presentation of the products on our homepage does not represent a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order training and services. By ordering the desired product, the consumer makes a binding offer to conclude a purchase contract.
(4) Upon receipt of an order on our homepage, the following regulations shall apply: The client/consumer makes a binding offer to enter into a contract by successfully completing the order procedure provided on our homepage.
The order is placed in the following steps:
1) Selection of the desired training / service
2) Detail page with calendar is called up automatically
3) Date selection by clicking the button "continue"
4) Input page for personal contact data is called up automatically
5) Input of personal data (contact data)
6) Clicking the button "continue"
7) Selecting the payment method
8) Binding submission of the order by clicking the button "Pay now"
9) Thank you page is automatically called with the message: "Thank you for your booking, you will receive a confirmation by email"
Before the binding submission, after checking his data of the order, the consumer can, by pressing the "back" button in the Internet browser, return to the Internet page where the customer's data are recorded and may correct input errors or cancel the ordering process by closing the Internet browser. We confirm the receipt of the order immediately by an automatically generated e-mail ("order confirmation"). With this we accept your offer.
(5) Saving of the contract text for orders via our homepage: We will send you the order data and our general terms and conditions by e-mail. You can also view the terms and conditions at any time at https://www.mindshift.world/agb ???. For security reasons, your order details are no longer accessible via the Internet.
§3 Prices, shipping costs, payment, due date
(1) The prices stated on our homepage do not include the statutory sales taxes and further price constituents.
(2) The consumer has the option of payment by credit card (Visa, Mastercard, American Express).
§4 Execution
The agreed service is to be executed by Mindshift to Excellence GbR Torcuk and Hartl within the agreed time frame, provided that the defined minimum number of participants is reached. In the case that a minimum number of participants in not reached, we reserve the right to organize a substitute date in which the minimum number of participants is reached. We are entitled to have the activity carried out in whole or in part by commercial/freelance cooperation partners. In the case of open seminars, the registration of participants takes place via our homepage (see §2 (4)). Since the number of participants in open seminars is limited for didactic reasons, registrations are considered in the order in which they are received. The registration becomes binding only through a booking confirmation.
§5 Delivery
Unless we have clearly stated otherwise in the product description, all products offered by us are ready for immediate shipment on the date specified on the homepage and selected when the order is placed. The delivery takes place on the specified and selected day. In this case, the period for delivery begins to run on the day after the conclusion of the contract.
§6 Retention of title and intellectual property protection
We retain ownership of the product until the purchase price has been paid in full.
The right to use the results of our work shall apply exclusively for the client's/consumer's own purposes even after payment of the fee. The customer/consumer guarantees that the documents created by us in whatever form within the scope of the order will only be used for his own purposes. All rights, including those of translation, reprinting and reproduction of the seminar documents or parts thereof are reserved by us and are only permitted with our written consent.
§7 Right of withdrawal of the customer as a consumer

Consumers are entitled to a right of revocation in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity:

You have the right to revoke this contract within fourteen days without stating any reasons. The revocation period is fourteen days from the day of the conclusion of the contract.

by means of a clear declaration (e.g. a letter sent by mail or e-mail) about your decision to revoke this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of revocation
If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.
If you have requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.
